Because cannabis and its derivatives are in the Schedule 1 category, CBD products that are not Epidiolex are also considered Schedule 1 substances at the federal level (your state has the final say on whether cannabis and CBD specifically are safe and legal for consumption, more on this below). In making this scheduling determination, as indicated in section 811 (d) (), it is necessary to evaluate the relevant requirements of the Single Convention. Under the treaty, cannabis, cannabis resin and cannabis extracts and tinctures are listed in Schedule I. The cannabis plant contains more than 100 cannabinoids.
These include tetrahydrocannabinols (THC) and CBD. Material containing THC and CBD extracted from the cannabis plant is included in the list of cannabis extracts and tinctures for the purposes of the Single Convention. Therefore, that material, which includes, among other things, a drug containing CBD extracted from the cannabis plant, is a Schedule I drug under the Single Convention. The treaty includes “cannabis and cannabis resin” in Schedule IV, with the resin being the part containing THC, CBD and other cannabinoids.
That location was not without controversy, but it established the model for all signatories, including the United States. The substances included in this list have a low potential for abuse compared to substances included in Schedule IV and consist mainly of preparations containing limited quantities of certain narcotics. Therefore, the fact that CBD is still linked to marijuana in the DEA's mind might not be a problem if marijuana as a whole ends up being legal.
Both the legalization of CBD and that of cannabis have become global phenomena, increasing political pressure to update laws. However, based on the available evidence, the FDA has concluded that none of these are the case with THC or CBD. As mentioned above, the Single Convention requires parties to require a permit for the import and export of medicines included in Schedule I of the Convention.
